Nature of action: A section 39(2) order by consent under section 37.1 of the Health Professions Act, RSBC 1996, ch. 183 (the “Act”), providing for a reprimand, a suspension to be served from December 16, 2014 to January 26, 2015 (inclusive) and a requirement to pay costs.
Reasons: The former registrant admitted to:
- Contravening section 75 of the College’s Bylaws and section 2(b) of the Code of Ethical Conduct, being Schedule “C” to the College’s Bylaws, by engaging in sexual conduct with the complainant, a former patient, within one year of termination of massage therapy;
- Improperly using the complainant’s confidential personal information, given for the purposes of obtaining massage services, to contact the complainant for personal and romantic reasons; and
- Pressuring the complainant not to make a complaint to the College about his sexual misconduct by threatening to contact the police, texting “Okay [Name]. Go to the College of BC. I will go to the Vancouver Police.”
