Nature of action: Pursuant to section 35(1)(a) of the Health Professions Act (the “Act”), the Inquiry Committee (the “Committee”) made an order suspending the former registrant’s practice during the Committee’s investigation and pending any hearing of the Discipline Committee.
Reasons: The College received a report alleging that the former registrant physically assaulted a physician on or around December 5, 2014, causing the physician serious injury. The former registrant has been charged with aggravated assault under section 268(2) of the Criminal Code in connection with this matter. The Committee was satisfied that the information available indicated that the former registrant represented a real risk to the public due to the seriousness of the alleged conduct, the lack of any measures currently in place to protect the public, and a real probability of harm to the public. The Committee took immediate interim action it considered necessary to address immediate public protection concerns.
Important note: Limits, conditions and suspensions ordered by the Inquiry Committee under section 35(1) of the Act are made to protect the public during an investigation or pending a hearing of the Discipline Committee. Measures taken under section 35(1) of the Act pertain to matters which are and remain unproven unless admitted by a former registrant or determined by the Discipline Committee.
